The rules for using the service

Terms and conditions

These terms govern your use of the Now We're Cooking mobile app, website and related services. Please read them before using the service or buying Premium.

1. Who we are and agreement to these terms

Now We're Cooking ("NWC", "we", "us" or "our") is operated by Dan Donovan, of 8 Vicotria Road, Workington, CA14 2QT, United Kingdom. Contact us at dan@nowwerecooking.com.

By creating an account, using the service or purchasing Premium, you agree to these terms and our Privacy Policy. If you do not agree, do not use the service. If you are under 18, you confirm that a parent or legal guardian has approved your use and any purchase.

2. What the service does

NWC helps you record food, scan products and receipts, receive expiry reminders, build shopping lists, and find recipes based on available ingredients and preferences. Some features use automated image analysis and third-party food or recipe data. Features may differ by device, region, plan and app version.

3. Accounts and guest use

You may be able to use parts of the app locally without an account. If you create an account, you must provide accurate information, protect your login details and tell us promptly about suspected unauthorised access. You are responsible for activity performed through your account unless caused by our failure to use reasonable care.

4. Food, allergy and health warning

NWC is not medical, dietary or food-safety advice. AI scans, barcode matches, expiry estimates, nutrition information, recipe filters and allergen checks may be incomplete or wrong. Always inspect food, follow storage guidance, check original packaging and ingredient labels, and use your own judgement. If you have an allergy, intolerance, medical condition, are pregnant, or need clinical nutrition advice, consult an appropriate healthcare professional. Never rely on NWC to determine whether food is allergen-free or safe to eat.

5. AI scans and user-provided content

You choose which photos and other content to submit. You must have the right to use that content and must not upload unlawful material or images containing unnecessary personal, confidential or payment information. Receipt scans may reveal merchant, date, item and price information; crop or avoid anything you do not want processed.

You retain ownership of your content. You grant us a limited, worldwide, non-exclusive licence to host, transmit, reproduce and analyse it only as needed to provide, secure and support the requested service. This licence ends when the content is no longer reasonably required, subject to backups and legal obligations.

6. Premium subscriptions

Premium may be offered monthly or yearly. The exact price, currency, billing frequency, trial eligibility and renewal date shown in the Apple App Store or Google Play checkout control your purchase.
Subscriptions automatically renew unless cancelled through the store before the renewal deadline stated by that store.
You can manage or cancel an Apple subscription in your Apple account subscription settings and a Google Play subscription in Google Play's subscription centre.
Deleting the app or your NWC account does not cancel a store subscription.
After cancellation, Premium normally remains available until the end of the paid period. Refunds and cooling-off rights are handled by the store under its policies and applicable law. Nothing in these terms removes any mandatory consumer right.
We may change future subscription pricing or benefits with the notice and consent required by the store and applicable law. Existing paid access will not be removed retrospectively except where necessary for law, security or serious misuse.

7. Acceptable use

You must not:

break the law, infringe another person's rights, or upload harmful, deceptive or abusive content;
attempt to bypass security, purchase verification, feature limits or access controls;
interfere with the service, introduce malware, scrape it at scale, or overload our systems;
reverse engineer the service except to the limited extent the law expressly permits;
resell, sublicense or commercially exploit the service or its recipe catalogue without written permission; or
use automated outputs as a substitute for professional medical, dietary or food-safety judgement.

8. Our content and third-party material

The app, branding, software, layout and original content are owned by us or our licensors and are protected by intellectual-property law. We grant you a personal, limited, revocable, non-transferable licence to use the service for lawful, non-commercial purposes.

Product, nutrition, image and recipe information may come from sources such as Open Food Facts and third-party publishers. Their content may be subject to separate licences, attribution requirements and terms. We do not claim ownership of third-party material and cannot guarantee its accuracy or continued availability.

9. Availability and changes

We aim to provide a useful and reliable service, but do not promise uninterrupted or error-free availability. We may maintain, update, suspend or discontinue features for security, legal, technical or commercial reasons. Where a material change adversely affects a paid service, we will provide reasonable notice where practicable and honour applicable consumer rights.

10. Suspension and termination

You may stop using the service at any time. We may restrict or terminate access if you seriously or repeatedly breach these terms, create security or legal risk, or misuse the service. Where appropriate, we will give notice and a reasonable opportunity to remedy the issue. Terms that by their nature continue after termination—including intellectual-property, liability and dispute provisions—will remain in force.

11. Responsibility and liability

We are responsible for losses that are a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for losses caused by circumstances outside our reasonable control, inaccurate information you supply, your failure to follow food-safety guidance, or third-party services we do not control.

The service is supplied for personal and domestic use. We are not liable for business losses such as lost profits, revenue, contracts, opportunity or business interruption. Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights.

12. Privacy

Our Privacy Policy explains what information is processed, why, how long it is kept, the providers involved and your rights.

13. Changes to these terms

We may update these terms to reflect changes to the service, law or security requirements. We will post the revised terms and update the date above. If a change materially affects you, we will provide reasonable advance notice where required. Changes do not remove rights you already have for an existing purchase.

14. Governing law and disputes

These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you may also bring proceedings in Scotland or Northern Ireland as applicable. If you live in another country, you retain any mandatory protections and court rights provided by the law of your home country.

Please contact us first so we can try to resolve a problem informally. You may also have access to consumer advice, alternative dispute resolution or the courts.

15. General

If any provision is found unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver. You may not transfer your rights under these terms without our consent; we may transfer our rights and obligations only where this does not reduce your protections. These terms, the Privacy Policy and the store checkout terms form the agreement relating to your use and purchase of the service.
